Unconstitutionality of Single Agency of Maritime Security Establishment Effort

Abstract

Discourse of establishment of Single Agency has been put forward again during drafting of bill of maritime security. Role as Single Agency will bring some extra authority e.g. as investigator. Meanwhile, there are some institution with investigator authority by law. This research aims to discuss about establishment effort of Single Agency from legal point of view, base on the Constitution of 1945 as Indonesian supreme legal basis with the other relevant legal basis. By qualitative and empirical law research approach, this research got result that establishment of Single Agency is unconstitutional because contradict with the Constitution of 1945, so that it doesn’t have binding legal force.
