The Urgency of Establishing an Independent Personal Data Protection Institution as a Strategy to Safeguard Privacy Rights in the Digital Era
Abstract
Privacy rights encompass the right to enjoy life and the right to be left alone, both of which are legally protected. Personal data is considered a fundamental human right in the realm of privacy, as it is often used by certain parties to identify individuals. This study examines: (1) the legal framework governing privacy rights over personal data under international and national law, (2) the urgency of establishing an independent personal data protection institution, and (3) strategies for protecting personal data privacy in the digital era through such an institution. This research employs a normative juridical method using statutory, conceptual, and comparative approaches. Secondary data sources include primary, secondary, and tertiary legal materials, collected through library research. The study concludes that personal data privacy is recognized under international and national law and highlights the necessity of establishing an independent Personal Data Protection Institution with clear mandates and inter-agency coordination.
