Legal Protection for Workers Based on Law Number 6 Of 2023 about Employment on Create Work Law
Abstract
Law Number 13 of 2003 on Manpower in Indonesia regulates the relationship between employers and fixed-term contract workers. With the evolving dynamics in the labor market, this law requires adjustments. Consequently, Law Number 6 of 2023 was introduced to strengthen protection for contract workers and foster a more conducive investment climate. This study aims to analyze the changes introduced by the Omnibus Law in the context of industrial relations in Indonesia, focusing on its positive and negative impacts on employers and workers. The empirical study analyzes law as a behavioral pattern in social interactions using a statute approach, evaluating the alignment between legal regulations and field realities, as well as their impact on social dynamics. The findings show that while the new law enhances worker protections, it also raises challenges, such as legal uncertainty and potential misuse by employers. The study recommends effective oversight, law enforcement, and ongoing policy evaluation to balance worker protection and business flexibility.
